You probably know that i said i was making a DOND game similar to Big Jons version (UK) and that i switched the project to the 360 but i promised i would finish the PC one. Well i got slapped with a C & D from endemol on the 12th August because i let some people beta test the PC version and they got me. But now as i let out an early version of my 360 game Endemol has sent another C & D. Even to the extent that Microsoft even said that i have to stop development. So sorry guys no new DOND game. This is probably likely because of the new DVD and DS and because of Virtual Me. Again, i am sorry. :cry:

Seriously, stand up to them, let them threaten all they like. They wouldn't dare drag you through the courts, because of the bad publicity it would get them.

That might not be the case. If it has been mentioned on these forums regarding any beta testing for either the PC & 360 versions, then Endemol will use the C & D regardless if anybody did become a whistleblower.

now endemol won't take me to court because they are not too much bothered about a flash version PC game, however they would be bothered about a commercial 360 game. However, Microsoft would be taking me to court instead of Endemol. :(

I suppose if you're doing it for profit they've got a case, to be fair. Any unlicensed commercial use of aspects of DOND, or any other TV show, will get you into trouble.

It's the way they clamp down on harmless, free to play games which people have written for themselves and other fans, for no financial gain, which I really can't stand.

hmmm interesting thoughts steve. I suppose that i could make the Xbox 360 game for free. And if popular enough commercially release with the rights from Microsoft to save my own bacon :)

It's interesting that Endemol are happy to throw around C&D orders when I know there's a website that's screencapping E4 continually and playing audio. I'm amazed Channel 4 are letting it go too.

Releasing it for free is still illegal, since you'll be using Endemol's preciously owned and trademarked content ;)

Well, Endemol dont own your 360 now, do they? So thats unlikely aswell i think

I reckon, in fact i am 95% certain as it has been proved before, that people from endemol are lurking around here - and thanks to steve, they can now do that anonymously.

If they want to be detected anonymously, they can do so themselves with their own endemol server without the need for commercial anonymizers aimed at home users.

Plus, they're well within their rights to join, talk, and even spy. None of those are a bannable offence to which any of us could take action against.

I posted the link so that people whom so wish can anonymize themselves and stand a chance at battling C&Ds, not the other way around :x

Let's be frank here. Endemol are in it for the money. They own the rights to DOND and anything they see as competition to their own official game they see as taking the bread out of their mouths.

They are a big greedy corporation only interested in money. End of.

If you are going to break any laws, it is always wise to know exactly which laws it is that you are breaking! ;)

There are two types of people who infringe on copyright, those who do it for profit, and those who do things as fans, for the love of the show, and don't make any money at all. Both are technically illegal.

But here is the rub:

In order to succesfully chase the pirate merchants on eBay for example who are trading in dodgy T-shirts, mugs and dvds, they have to prove that the courts that they are chasing everybody equally.

This is why you occasionally hear of cases where Disney takes some pre-school nursery to court for having a mural on their classroom wall of snow white and the seven dwarfs. It's not that they are against the idea per se, it's just that they have to prove that they are taking reasonable steps to protect their copyright.

Endemol have the same problem - in order to chase the big guys, they also need to chase the little guys, the fans. Warner Bros did the same thing a few years back to a young 15year old girl who had registered a Harry Potter fansite and handed her down a C&D order. In most cases like this they eventually back down and tolerate fan sites like dond.co.uk (though Kestral had a C&D of his own when he first began and was told to remove the images section).

Therein ends todays legal lesson by Mental Mickey, now available for all your legal needs and requirements. I have never lost a case yet! I've not yet had any actual cases mind you, but that is still a 100% success rate!

In this case, you don't really have a leg to stand on! It's a bit heavy-handed granted, but that is how the system works! :-)
